Terms of Service
1. About these terms
These Terms of Service ("Terms") form a legal agreement between you ("the Customer", "Manager", or "Employee") and Superb Wellness ("Superb", "we", "us"), a business based in Scotland, United Kingdom. They govern your use of the Superb Manager and Superb Employee applications and the superbwellness.co.uk website (collectively "the Service").
2. The Service
Superb provides a workplace wellbeing platform consisting of two linked applications:
- Superb Manager: a dashboard for managers to view anonymised team wellbeing data, manage feedback, run fitness competitions, and access optional add-on features
- Superb Employee: an application for employees to submit weekly check-ins, send feedback, participate in competitions, request holidays, complete training courses, and access wellbeing resources
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, provided we give reasonable notice to active subscribers.
3. Accounts and eligibility
To use Superb you must:
- Be at least 16 years of age
- Be acting on behalf of a legitimate business or organisation
- Provide accurate and complete information when creating an account
- Keep your login credentials secure and not share them with others
- Notify us immediately if you suspect unauthorised access to your account
You are responsible for all activity that takes place under your account.
4. Subscriptions and payment
Superb is offered on a monthly subscription basis. Pricing is as set out on our pricing page at superbwellness.co.uk and may be updated from time to time with 30 days notice.
- Free trial: New manager accounts receive a 60-day free trial. A valid payment method must be provided at signup but will not be charged until the trial ends.
- Billing: Subscriptions are billed monthly in advance on the same date each month. Payment is taken via Stripe.
- Add-ons: Optional add-on features are billed in addition to the base plan at the rates shown in the pricing page. Add-ons can be enabled or disabled at any time, with changes taking effect from the next billing cycle.
- Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are given for unused portions of a billing period.
- Failed payments: If a payment fails, we will notify you by email and retry after 3 days. If payment continues to fail, your account may be suspended.
5. Acceptable use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service to harass, bully, or intimidate employees or colleagues
- Attempt to identify anonymous employees from their feedback or check-in data
- Upload content that is illegal, offensive, defamatory, or infringes third-party rights
- Attempt to gain unauthorised access to other accounts or parts of the platform
- Use the Service in a way that could harm, disable, or overburden our infrastructure
- Reverse engineer, copy, or create derivative works of the platform
- Use the platform to store or transmit malicious code
We reserve the right to suspend or terminate accounts that violate these rules without refund.
6. Manager responsibilities
Managers who subscribe to Superb on behalf of their organisation agree to:
- Inform employees that the Superb Employee app is being used in the workplace and explain how their data is handled
- Not attempt to de-anonymise employee feedback or check-in data
- Use the platform to support employee wellbeing, not to monitor or penalise employees
- Ensure that any regulations or course content uploaded to the platform is accurate and lawful
- Comply with applicable employment law in Scotland and the UK when using holiday approval features
7. Employee data and anonymity
Superb is designed to protect employee privacy. However, you acknowledge that:
- Named feedback and named holiday requests are visible to your manager by design
- Your display name is visible to your manager in the employee directory
- Your course completion status is recorded and may be visible to your manager
- Truly anonymous submissions (anonymous feedback and weekly check-ins) are not linked to your identity at any point in our system
8. AI-generated content
The AI Wellness Resources add-on uses the Claude API by Anthropic to generate wellbeing articles on demand. You acknowledge that:
- AI-generated content is provided for general information purposes only and does not constitute medical, psychological, or professional advice
- We do not guarantee the accuracy or completeness of AI-generated content
- Employees experiencing a mental health crisis should contact their EAP or a crisis service, not rely on AI-generated articles
- No personal data is sent to Anthropic when generating articles — only the article topic is passed
9. Intellectual property
The Superb platform, including its design, code, trademarks, and branding, is owned by Superb Wellness. You are granted a limited, non-exclusive, non-transferable licence to use the Service for the duration of your subscription.
Content you upload to the platform (regulations, course materials, feedback messages) remains your intellectual property. By uploading it you grant us a limited licence to store and display it for the purpose of providing the Service.
10. Limitation of liability
To the fullest extent permitted by law:
- Superb is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service
- Our total liability to you for any claim arising under these Terms shall not exceed the total amount paid by you in the 3 months preceding the claim
- We are not responsible for the accuracy of content generated by the AI Wellness Resources feature
- We are not responsible for employment decisions made by managers using data from the platform
11. Termination
Either party may terminate the agreement at any time. We may terminate your account immediately if you breach these Terms. Upon termination, your access to the Service will cease and your data will be deleted in accordance with our Privacy Policy.
12. Governing law
These Terms are governed by the law of Scotland. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Scottish courts.
13. Changes to these terms
We may update these Terms from time to time. We will notify active subscribers by email at least 14 days before material changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
